Three weeks following India’s Supreme Court Judgement to decriminalize gay sex, their top court has decided to decriminalize another British-colony-era law, adultery. Since 1860, a man could be jailed for up to five years if he had sex with a married woman without getting her husband’s permission. It’s important that India has been decriminalizing these outdated laws as India continues to rise and evolve as a global power, their society must also evolve. This law discriminates against not only the men tried and convicted, it also discriminates against women as it promotes the idea of women equating property. While 80 other countries don’t criminalize adultery, many nearby Asian countries do consider it illegal, as do some states in the United States. The law has been widely misused in the years since it’s creation, as angry husbands utilize \u201cmalicious prosecution on the ground of adultery\u201d to gain the upper hand in legal processes. This also adds to the discrimination of women since they cannot defend themselves in court, they’re left to deal with the subsequent punishment without the opportunity to dispute the claim. The law has been criticized as it hasn’t proved to prevent extramarital relations, and although there’s no evidence that decriminalizing the law will “threaten the sanctity of marriage,” the judgement has been noted to not be an allowance or encouragement for adultery.<\/p>\n","protected":false},"excerpt":{"rendered":"
