The International Seabed Authority (ISA) met recently in Jamaica, focusing on how and if to allow deep-sea mining. An international and environmental lawyer and legal adviser to the Deep Sea Conservation Coalition (alliance of environmental groups) claimed that if the US would accept, it would be a huge breach of international law. They also said that the Metals Company’s actions were “insulting to the ISA” and “It’s an extremely irresponsible threat. It’s basically holding a gun to the international community”. The ISA is accepted by more than 165 nations, but not the US. The Metals Company says that since the United States is not a part of the ISA, they do not have to follow their rules and the company could therefore start deep-sea mining operations under US permission. Due to the environmental impact of deep-sea mining, more than 30 countries including Canada have called for a pan or pause on deep-sea mining. But, some companies argue that deep-sea mining is a cheaper alternative as well as less impactful than land mining. The Metals Company has goals of attaining seafloor minerals such as cobalt, copper, and nickel and manganese.

These actions are very important because they showcase how even despite efforts to create world institutions that all countries follow, as discussed in class, there is no international government that can force one country to abide by the formulated ‘laws’ of the world. This also brings to light the difficulty of creating rules to bring about shared goals of the world because all countries have their own national interest in mind and will do what they deem best for their own nation- not necessarily others. These agreed upon ‘laws’ are also fluid in the way that states who previously agreed to them can at any time leave the institution and do their own thing since they are not infinitely bound. Interestingly, the Metals Company based in Canada (who doesn’t really support deep-sea mining) is trying to work through the US who operates on its own concerning these issues. Seen here as well, is the idea that countries with greater power on the global stage have more room to act as they wish regarding international set rules and that it is typically less powerful countries who are more strongly bound to international rules. It could be concerning if the US accepts the Metals Company’s request because it could cause other countries/actors to see that they too can bend international rules to benefit themselves.

Link to article:https://apnews.com/article/canada-us-deep-sea-mining-isa-d24270d1674ce93035adc1e0be511725 The Metals Company based in Vancouver, Canada, mentioned that it is looking towards the US government to allow them to start deep-sea mining in international waters, skipping the International Seabed Authority that could grant them exploitation permits.
