The former Brazilian president Jair Bolsonaro was sentenced to 27 years and 3 months in prison convicted of plotting a coup to keep him in power, after he lost the 2022 presidential election. The decision was made by the Brazilian supreme court, 4 out of the 5 judges found him guilty of: taking part in an armed criminal organization, attempting to violently abolish democracy, organizing a coup, and damaging government property and protected cultural assets. One judge, Luiz Fux, acquitted the former president of all charges questioning the court’s jurisdiction. In addition, Bolsonaro makes history being the first Brazilian president to get sentenced for undermining democracy. However, this decision was disliked by U.S. President Donald Trump who called the case a “Witch Hunt” and retaliated with higher tariffs, sanctions against the presiding judges, and revocation of visas for most of the high court judges.
This article is significant because it shows the Brazilian court’s are serious about upholding democracy by holding a former president accountable for trying to overturn democratic election results. In the past (1964-1985) Brazil endured military coups and weak government norms. This case shows how they are learning from history making sure they won’t repeat their previous mistakes. However, a downside to the decision will be more political polarization in Brazil, as in the 2022 election, Bolsonaro was one of the front runners to win.
Bolsonaro will most likely request a second review of the evidence, questioning whether the supreme court has legal jurisdiction, similar to the arguments of Luiz Fux. The United States also has a big stake in this as Brazil is the largest democracy in South America and a big trading partner with the United States. Higher tariffs by the president can cause some panic in Brazil and possibly changing the whole outcome of the case.
A decision like this shows the strength in Brazil’s authority, as the country is a democratic regime having three branches of government and holding competitive elections deciding the outcome of leadership. This demonstrates that no one is above Brazilian law, even a former president. It also shows the self determination of the judiciary branch not basing their decision off of political pressures or outside political opinions. Having the ability to enforce constitutional and legal norms, The Brazilian government reinforces public trust in their own institutions, sending a clear message that the people with authority will have the final say.
