Some Brazilian Supreme Court justices agreed that the former President Jair Bolsonaro and some of his companions will be put on trial for five counts: attempt to stage a coup, involvement in a named criminal organization, attempted violent abolition of Democratic rule of law, damage characterized by violence/threat against state’s assets, and deterioration of listed heritage. The Supreme Court panel will look over existing evidence and potentially get new evidence and hear testimonies. Experts project that Bolsonaro could be sentenced up to 40 years in prison. This formal accusation came from a federal police investigation that put Bolsonaro on the top of a criminal organization who had been active since 2021. The prosecutor also accused Bolsonaro of supporting a plan that included poisoning the current President Luiz Silva and killing Supreme Court Justice Alexandre de Moraes. A specific date for the trial has not been set yet, but an outline of the procedural framework is expected by the Supreme Court panel in the next few days. If Bolsonaro does anything that could limit the court’s ability to deliver its ruling (like taking shelter in an embassy) he could be arrested before the trial even ends. Bolsonaro has been banned from running for office until 2030 due to abuse of power and undermining confidence in the country’s voting system. He denies all wrongdoings, claiming he is a victim of political persecution.

This event is a test in Brazil’s democracy. The trial shows that Brazil and their judicial system is willing to hold high-ranking officials accountable for actions that threaten their democracy. This trial is a part of a wider pattern in the region, where previous leaders are more often being prosecuted for abuse of power and anti-democratic actions (like Peru’s former president who was arrested after attempting to dissolve Congress). Bolsonaro’s supporters may see this trial as politically motivated persecution as Bolsonaro claims himself which could cause deeper political divisions (Bolsonaro is right wing). This could impact one of two ways. First, this trial could strengthen democracy in Brazil showing that they stand strong for democratic principles or if a lot of the population sees it as politically motivated, it could stir political unrest through protests or even violence.

The Brazilian government will showcase the trial as a needed step in upholding democracy and prevent sliding back into something more authoritarian. The military in Brazil has historically influenced Brazilian politics, so they may try to maintain neutral in the situation, but some areas within the military do align with Bolsonaro. Political instability in Brazil may impact Latin America as a whole, which could affect economic and diplomatic ties with other countries.
